The petitioner has prayed for bail in a case registered for the offence punishable under sections 363 and 366(A) and 34 of the Indian Penal Code.

As per allegation in the FIR, daughter of the informant went to Durga Temple but did not return then a search was made by her family members. During search, informant came to know by villagers that his daughter was seen with petitioner and co-accused Prince Kumar going towards Dhamdaha by motorcycle.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case on the basis of suspicion. After recovery of the victim girl, her

Patna High Court CR. MISC. No.51524 of 2022(3) dt.17-02-2023 2/2 statement has got been recorded u/s 164 Cr.P.C. wherein she has not made any allegation of wrong doings against the petitioner. As per medical report, there was no sign of sexual assault and doctor has assessed her age as 18-20 years. Petitioner is languishing in judicial custody since 05.04.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Purnea in connection with Dhamdaha P.S. Case No. 52 of 2022.
