The petitioner apprehends his arrest in connection with Rail Ara P.S. Case No.88 of 2019/G.R. No.119 of 2019 registered under Sections 341, 323, 504 and 379 of the Indian Penal Code.

The accusation is that on 02.06.2019, the informant Babita Devi along with her husband Rambabu Manjhi and two children were coming from Indore boarding on the train. When the train stopped at Ara Station, the informant along with her husband children got down from the train. At that time, one person came and started to abuse the husband of the informant and cause assault. When the informant made query, he also

He also snatched the gold chain and mobile of the informant and took the husband of the informant to the house causing assault. When the informant asked about the name of that person, then informant came to know the name of that person as Jitendra (petitioner).

Learned counsel for the petitioner submits that, in fact, Indore-Rajendra Nagar Express was passing over through Ara Railway Station but some persons by chain pulling stopped the train and got down from that train. At that time, Rambabu Manjhi, the husband of the informant, and one Deepak Kumar Gupta, were apprehended on chase, which would appear from Annexure-2 and 2/1 to this application but with an ulterior motive, the informant has lodged the present case. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate Railway, Ara, in connection with Rail Ara P.S. Case
