Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 324, 379 and 354(B)/34 of the Indian Penal Code, registered in connection with Hajipur Sadar P.S.Case No. 354 of 2021.
The learned counsel for the petitioner has submitted that the specific allegation on the petitioner is to inflict iron rod blow on the head of the informant, but the informant has not received injury on his head.
On the other hand, learned APP has opposed the prayer for bail.
Considering the above facts and circumstances, let
Patna High Court CR. MISC. No.50976 of 2022(3) dt.18-01-2023 2/2 the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S.Case No. 354 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
The learned court below shall verify the injury report and if it is found that the informant has sustained injuries on his head, the learned court below shall be at liberty to cancel his bail bond.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
