JUSTICE ARUN KUMAR ORAL ORDER 18-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.6.2017 seeks bail in Bathnaha PS Case No. 53 of 2017 registered under Sections 302 and 34 of the IPC.
The allegation in brief is that while the informant was going along with her husband to bus stand then in the way the accused persons surrounded her husband, stabbed him by knife and it is alleged that this petitioner and Mintu Rai stabbed with knife in the chest, back and arms.
Learned Counsel for the petitioner submits that all family members have been made accused, there is accusation against all of them that they assaulted but later on the informant alleges specific accusation against the petitioner and Mintu Rai, two co-accused persons namely Pramod and Siya Ram have been admitted to bail by a coordinate Bench of this Court and the petitioner has been in custody for one year.
Whereas learned Counsel appearing for the State submits that there is specific accusation against the petitioner and Mintu Rai
Patna High Court Cr.Misc. No.30075 of 2018 (4) dt.18-07-2018 having stabbed in the chest and back of the deceased. Having considered the said facts and circumstances, particularly the specific accusation against the petitioner, the prayer for bail of the petitioner is rejected.
