Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 406, 379 of the Indian Penal Code. The prosecution case is that the petitioner took Rs. 25,000/- as loan from the informant, when the informant demanded the money back, then petitioner assaulted with farsha on his head.
It is submitted by the learned counsel for the petitioner that for a petty dispute accusation has been levelled. There is nothing on record to suggest that the petitioner took the money. Though, the incised injury has been found on the scalp, but the same has been found to be simple in nature by
Patna High Court Cr.Misc. No.6613 of 2016 (2) dt.12-02-2016 the Doctor. There is no accusation of repeating the blow. The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Khajekalan P.S. Case No. 04 of 2016, pending in the court of learned S.D.J.M., Patna City.
With this observation this application is disposed of.
