JUSTICE ARUN KUMAR ORAL ORDER 08-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bariyarpur PS Case No. 101 of 2017 (S.Tr. No. 68 of 2018) registered under Sections 302, 201, 34 of the IPC and Section 27 of the Arms Act. The allegation in brief is that due to grazing of she buffalo protest was made and Shikandar Mandal shot at the informant's husband which hit him followed by indiscriminate firing by rest other five accused persons including the petitioner.

Learned Counsel for the petitioner submits that only two fire arm injuries were found on the person of the deceased; one is specifically attributed to Shikandar Mandal, similarly situated accused Awadhesh Mandal and Gore Mandal have been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 25802 of 2018 and Cr. Misc. No. 14403 of 2018 respectively. Having considered that case of the petitioner also stands on same footing to that of aforesaid two co-accused, the petitioner, namely, Rajesh Mandal is directed to be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.27963 of 2018 (2) dt.08-05-2018 sureties of the like amount each to the satisfaction of Sessions Judge, Munger, in connection with Bariyarpur PS Case No. 101 of 2017 (S.Tr. No. 68 of 2018).
