JUSTICE RAKESH KUMAR ORAL ORDER 08-05-2018 Heard Ranjan Kumar Jha, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, having clean antecedent, which fact has been stated in paragraph no. 3 of the petition and in custody has prayed for grant bail in connection with S.T. Excise No. 302 of 2018 ( arising out of Triveniganj P.S. Case No. 132 of 2018) registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that in the case save and except confessional statement of the co- accused there is no other cogent material to connect the petitioner in the present case. He further submits that petitioner was arrested while he was staying in a room of hotel and on the basis of

Considering the nature of accusation, clean antecedent of the petitioner as well as the fact that petitioner has been made accused on the basis of confessional statement of coaccused, let the petitioner - Vijay Kumar Bhagat be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge - Second cum Special Judge, Excise, Supaul / concerned court in connection with S.T. Excise No. 302 of 2018 (arising out of Triveniganj P.S. Case No. 132 of 2018 ).
