JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Bahadurpur PS case no. 107 of 2018 instituted for the offences punishable under Sections 353, 387 and other sections of Indian Penal Code.
The allegation of the prosecution is that the informant who is the headmaster of the Middle School, Basudeopur is stated to have said that the Assistant teacher Randhir Kr. Yadav, who is the main accused, came to the school and put his attendance in the register and thereafter, left the school. It is further alleged that the said Randhir Kr. Yadav had then committed some offence and in order to save his skin, had
Patna High Court Cr.Misc. No.29451 of 2018 (2) dt.21-05-2018 2/2 started putting pressure on the informant to make interpolation in the register.
The learned counsel for the petitioner submits that the petitioner had gone to the school at the request of one other co-accused namely Dukhi Yadav @ Dukhi Pd. Yadav, who is said to have threatened the informant, and the said co-accused person has already been granted bail by this court vide order dated 10.05.2018 passed in Cr.Misc. no. 28192 of 2018. It is further submitted that the petitioner is in custody since 20.03.2018 and he has a clean antecedent.
Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Darbhanga in connection with Bahadurpur PS case no. 107 of 2018.
