JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-02-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 504 of the Indian Penal Code. The prosecution case is that the petitioners along with accused persons came to the door of the informant and started abusing the informant when co-accused Mithun Kumar assaulted with axe on the head of the informant but it caused injury to his elbow and when the informant fell down then co-accused Mithlesh Kumar assaulted with lathi on the head of the informant causing injury. When the family members of the informant came to rescue then the accused persons including the petitioners made assault. It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.7200 of 2016 (2) dt.17-02-2016 2/2 petitioners that injury of the informant has been found to be simple in nature. The specific accusation of assault to the informant is against co-accused Mithun Kumar and Mithilesh Kumar. It is further submitted that informant kidnapped the minor daughter of the petitioner No. 1 at earlier point of time leading to the registration of Rajgir P.S. Case No. 253 of 2014 under Section 366(A) of the Indian Penal Code. Hence, as a retaliatory major the present case has been lodged. There is counter version of the occurrence also.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 259 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
