Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 409, 120(B) of the Indian Penal Code.

The prosecution case in brief is that the accused

No.60267 of 2021(2) dt.11-05-2022 2/3 persons opened an institution in the name of Central Bank Employee Savings & Credit Self Self Supported Co-operative Society Limited and opened its branch at Saharsa. The informant invested Rs. 1,58,100/- in one of the schemes in different installment in the year 2005 but when the informant demanded his money back on maturity, the accused persons refused to make payment. The petitioner was office Superintendent in the aforesaid Cooperative Society.

It is submitted by learned counsel for the petitioner that petitioner was only an employee of the alleged Cooperative Society and he has no role in the policy making process of the Cooperative Society. It is further submitted that collection of the alleged amount has not been made by the petitioner and no material is available against the petitioner to show his involvement in this case.

No.60267 of 2021(2) dt.11-05-2022 3/3 surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 260 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
