JUSTICE PRABHAT KUMAR JHA ORAL ORDER 02-05-2018 Heard learned counsel for the petitioner, learned counsel for the Additional Public Prosecutor and learned counsel for the informant.

The petitioner seeks bail in S.T. No.19 of 2017, arising out of Chauri P.S. Case No.42/2016, registered under Sections 307 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.

Earlier the prayer for bail of the petitioner was rejected vide order dated 01.05.2017 passed in Cr. Misc. No.11642 of 2017 with an observation that if the trial is not concluded within 9 months, the petitioner may renew his prayer for bail.

The allegation against the petitioner is that he made

Patna High Court Cr.Misc. No.13172 of 2018 (2) dt.02-05-2018 2/2 indiscriminate firing causing injury on left leg of the informant. The prayer for bail of the petitioner was earlier rejected taking into consideration that there is specific allegation against the petitioner and he has got criminal antecedent. The petitioner is in custody since 13.11.2016 and he has already remained in custody for about one year and six months.

Considering the aforesaid fact, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Bhojpur at Ara, in connection with S.T. No.19 of 2017, arising out of Chauri P.S. Case No.42/2016.
