A counter affidavit has been filed on behalf of Insurance Company (respondent no.8).
On the strength of the communication dated 15.12.2011, annexed with the counter affidavit of the Insurance Company, it has been submitted by Mr. Das that the insured amount has already been credited with the Cooperative Bank for disbursement to the petitioner. This appears to be the reasons for non appearance of the petitioner as he might have lost interest in pursuing the case. The application is dismissed for want of prosecution.
