Petitioner apprehend her arrest in connection with Kanti P.S. Case No. 824 of 2018 registered for the offence under Sections 363, 366(A) and 34 of the Indian Penal Code.
The allegation against the petitioner as per the first information report is that the informant on the date of the occurrence, i.e. 28.12.2018 at about 3:00 A.M. saw that Mukesh Kumar, Rekha Devi, Suman Patel and Satruhan Mahto were taking away his minor grand daughter aged about 14 years on the pick up van.
Mr. Sanjay Parasmani, learned counsel for the petitioner submits that entire family member of the petitioner have falsely been implicated in this case by the informant inasmuch as the informant as well as the petitioners are neighbours and there was love affairs
Patna High Court CR. MISC. No.46975 of 2019(2) dt.30-07-2019 2/2 between the victim girl and the son of the petitioner, namely, Mukesh Kumar. He relying on paragraph 6 of this petition submits that both Mukesh Kumar and the victim girl have eloped from their house and they were in love with each other. He further submits that Mukesh Kumar is the son of petitioner from her first husband and used to stay separately from the petitioner.
Having heard learned counsel for the petitioner and taking into consideration the fact that both the parties are neighbours and petitioner is the mother of Mukesh Kumar who is in love with the girl. Accordingly, I am inclined to enlarge the petitioner on bail. Let the petitioner, above named, in the event of her arrest or surrender before the court below within four weeks from today be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M (West), Muzaffarpur, in Kanti P.S. Case No. 824 of 2018 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
