2. The petitioner has filed the instant application for anticipatory bail, apprehending his arrest in a case registered for the offences punishable under Sections 420 of the Indian Penal Code and Section 138 of N.I. Act.

3. Earlier vide order dated 20.11.2024 with consent of both the parties, this matter was referred to the Mediation and Conciliation Center, Patna High Court, Patna.

4. It reveals from Memorandum of Agreement dated 24.01.2025 that both the parties agreed to settle the dispute and for this the petitioner has offered to pay a sum of Rs. 2,04,000/-

Patna High Court CR. MISC. No.53480 of 2024(5) dt.15-02-2025 2/3 (two lakhs four thousand only) as full and final settlement amount to opposite party no. 2. The opposite party no. 2 accepted the offer and gave her consent.

5. Petitioner has paid the aforesaid amount i.e. a sum of Rs. 2,04,000/- (rupees two lakh four thousand) in two installments through demand draft on 02.12.2024 and 07.01.2025 respectively.

6. Having heard learned counsel for the parties and considering the facts mentioned in Memorandum of Agreement before Patna High Court Mediation Center, this Court is inclined to enlarge the petitioner on anticipatory bail.

The above named petitioner is directed to be enlarged on anticipatory bail in connection with complaint case no. 3539(C) of 2012 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Samastipur.

8. Trial Court is directed to confirm the bail granted to the petitioner after verifying the deposit receipts of payment of the entire amount i.e. Rs. 2,04,000/- (two lakhs four only) by the petitioner to the opposite party. Trial Court will also verify the withdrawal of pending cases between both the parties.

9. Accordingly, the instant application stands disposed of.
