The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Maner P.S. Case no. 144 of 2020 instituted for the offence punishable under Sections 147, 148, 149, 341, 452, 323, 429, 354, 380 and 427 of the Indian Penal Code.

As per allegation in the FIR, several co-villagers including the petitioners entered into the house of the informant lashed with weapons. Petitioner no. 2 broke his box and took out Rs. 25,000/- and jewelries and when objection was raised by

Patna High Court CR. MISC. No.60162 of 2021(2) dt.22-06-2022 2/3 the informant, they destroyed the doors, windows and motorcycle. Petitioner no. 3 assaulted the cattle of the informant with spear. When his wife and sister-in law came there for his rescue, they were also beaten up by the accused persons and petitioner no. 4 tried to outrage the modesty of his sister-in-law. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. The present case is counter blast of Maner P.S. Case No. 147 of 2020 filed by one of the co-accused against the informant. Only with a view to make the case non-bailable in nature there is super addition of allegation of modesty and theft. Both are on inimical terms. None of the independent witnesses of the vicinity has supported the prosecution story. Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Maner P.S. Case no. 144 of 2020, they will be enlarged on bail on furnishing bail bond of

Patna High Court CR. MISC. No.60162 of 2021(2) dt.22-06-2022 3/3 Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
