JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 341, 323, 379, 354/34 of the Indian Penal Code and under section 3(1) (x) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that on 02.08.2014 while the informant was sitting at his door the petitioners came and started abusing the informant by taking his caste name, they assaulted the bhabhi of the informant, caused injuries to Navlesh Paswan, Chanda Devi, Aarti Devi and took away golden chain worth Rs. 55,000/-.

No.7269 of 2016 (2) dt.18-02-2016 2/3 It is submitted by the learned counsel for the petitioners that on conclusion of investigation petitioner No.2, Satwant Kumar, and petitioner No.3, Pinku Singh, were not sent up for trial but differing with the final form learned ACJM took cognizance against them under section 341, 323, 354/34 of the IPC and Section 3 (1) (x) of the SC/ST Act on 09.02.2015, however, petitioner No.1 was charge sheeted under sections 341, 323, 354/34 of the IPC and Section 3(1) (x) of the SC/ST Act. There is counter version of the occurrence and all the injured have received simple injuries.
Let the learned court below consider the prayer for regular bail of the petitioner No.1, Ravinder Singh @ Ravindra Singh in case he surrenders within six weeks from today in connection with Jamhore P.S. case No. 91/2014 pending in the court of learned A.C.J.M., Aurangabad.
This application is disposed of with the aforesaid observation/direction.
Considering the fact that petitioners No.2 and 3 were not sent up for trial and Statement has been in paragraph 3 of the petition that they have no criminal antecedent, let the above named petitioners Nos.2 and 3 be released on anticipatory bail in the event of arrest or surrender before the

No.7269 of 2016 (2) dt.18-02-2016 3/3 learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Aurangabad in connection with Jamhore P.S. Case No. 91/ 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
