JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 14-09-2015 Heard learned counsel for the petitioner and the State. This writ application has been filed on behalf of the petitioner for a direction to the respondents to grant licence for N.P. bore pistol. It has been submitted that an application was filed on 28.07.2009 but no decision was taken till the date of filing of the writ petition.

A counter affidavit has been filed on behalf of the State appending therewith an order dated 12.08.2015 passed by the District Magistrate, Begusarai which has been appended as Annexure A by which the petitioner was granted arms licence for Begusarai District only.

Learned counsel for the petitioner submits that the petitioner

Patna High Court CWJC No.2541 of 2015 dt.14-09-2015 had applied for all India licence, however, the same has been granted for Begusarai District and nothing has been recorded in the order concerned as to why he cannot be even granted licence for whole of the State of Bihar for which the licensing authority was capable to do. In above view of the matter, this writ application is being disposed of with a direction to the District Magistrate, Begusarai, i.e., respondent no. 2, to take a fresh decision in the matter for grant of licence to the petitioner at least for the entire State of Bihar. The whole exercise must be completed by the licensing authority within a period of four weeks from the date of receipt/production of a copy of this order. So far all India licence is concerned, the petitioner would be at liberty, thereafter, to raise the matter for grant of licence to him for all India in accordance with law before the competent authority.
