The petitioner apprehends his arrest in Bhore P.S. Case No.162 of 2021, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. The petitioner along with other co-accused persons are said to have cheated the informant on the pretext of providing loan.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the occurrence took place on 28.12.2020, but the FIR was lodged on 10.04.2021 without any explanation. It is also submitted that the petitioner is ready to pay Rs.31,000/- to the informant. It is lastly

Patna High Court CR. MISC. No.60467 of 2021(3) dt.26-07-2022 2/2 submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the fact that the petitioner is ready to pay Rs.31,000/- to the informant, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of eight weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Bhore P.S. Case No.162 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.

The petitioner is directed to deposit Rs.31,000/- in the Nazarat of the learned court below at the time of furnishing bail bond and the learned court below is directed to hand over the same to the informant of the present case.
