The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 325, 307, 337, 506 of the Indian Penal Code.

The prosecution case is that the petitioners and other came to the grocery shop of the informant and demanded grocery without payment. On refusal of the same, they all assaulted the informant. It is specifically alleged that petitioner no. 1 Binod Singh and petitioner no.2 Pramod Singh assaulted on the head of Prasad Singh with iron rod. Though Amarendra Singh and Binod Singh

Patna High Court Cr.Misc. No.8545 of 2016 (2) dt.23-02-2016 assaulted the mother of the informant. The niece of the informant was also assaulted by the accused persons. It is submitted by the learned counsel for the petitioners that for a petty dispute with regard to drainage there was some scuffle between the petitioners and the informant being neighbours, leading to registration of First Information Report. All the injuries have been found to be simple in nature. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the genesis of the occurrence, the nature of injury caused and the weapon used, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 167 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K.
