2. Learned counsel appearing on behalf of the deceased employee, who is represented by his sons in the present petition, who have already been substituted, seeks to withdraw the present writ petition with liberty to file a detailed representation giving all the facts as well as law applicable in

Patna High Court CWJC No.1317 of 2017(13) dt.28-06-2023 2/2 the case of the petitioners, before the Additional Chief Secretary, Industries Department, Government of Bihar.

3. The Additional Chief Secretary, Government of Bihar must ensure to verify the service records relating to the petitioners and the representation filed on behalf of the petitioners, and pass a reasoned order in accordance with law, taking into consideration the settled law by the Apex Court in similarly situated employees.

4. The representation of the petitioners must be disposed of within a period of six weeks from the date of filing of the representation.

5. In case, the grievance of the petitioners are not sustainable and it relates to State of Jharkhand, in that case, the petitioners are required to be given prior notice of hearing and pass appropriate legal orders after hearing the petitioners in accordance with law.
