The petitioner seeks bail in Thawe P.S. Case No. 68 of 2016 registered under Section 392 of the Indian Penal Code. Three motorcycle borne criminals are said to have looted tractor of the informant by assaulting and getting alighted its driver.
It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession nor he was apprehended on the spot. He has also not been put on T.I.P. He has no concern with the aforesaid occurrence and has been falsely implicated in the case at the
Patna High Court Cr.Misc. No.31452 of 2018 (2) dt.22-05-2018 2/2 instance of his enemies. Though thirteen more criminal cases have been lodged against the petitioner, but he has been acquitted in two of the aforesaid cases and is on bail in the rest cases. Chargesheet in the case has been submitted. Petitioner has been languishing in custody since 22.12.2016. Co-accused Binod Yadav has been enlarged on bail by a co-ordinate bench of this court vide order dated 06.12.2017 passed in Cr. Misc. No. 53181of 2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Thawe P.S. Case No. 68 of 2018.
