1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Learned counsel for the petitioner, after some arguments, seeks permission to withdraw the present quashing application.
3. Permission is accorded with a liberty to the petitioner to raise all the issues at the time of framing of charges as it has been submitted by the learned counsel for the petitioner that the petitioner had taken charge from Raj Narayan Singh as Panchayat Secretary and at the time of handing over of charge, the documents related to the Teacher who had obtained appointment based on forged and fabricated certificate were not handed over to him for which the petitioner several times had
Patna High Court CR. MISC. No.51015 of 2023(2) dt.28-08-2023 2/2 corresponded with the B.D.O. bringing to his notice that the relevant documents have not been handed over to him at the time of taking charge, it is thus submitted that when the petitioner was not handed over the charge of the relevant documents and had already communicated about the same to the B.D.O., then where was the occasion for instituting the present FIR.
4. Accordingly, the present quashing application is dismissed as withdrawn.
5. The Court expects that in the event if discharge application is filed by the petitioner, the learned Court shall apply its independent mind and will take into consideration the issues raised by the petitioner as recorded hereinabove. (Satyavrat Verma, J) HarshPandey/- U T
