JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutors for the State. The petitioner apprehends his arrest in connection with Brahmpur P.S.Case No. 266 of 2014 registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

The petitioner was Panchayat Secretary at the relevant time and he purchased solar light in the year 2007-2008 violating the guidelines of the government.

The contention of the learned counsel for the petitioner is that the guidelines were issued in the year 2010 whereas the purchase was made in the year 2007-2008.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.4166 of 2015 (2) dt.30-01-2015 2/2 well as submissions of the parties, this anticipatory bail is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar, in Brahmpur P.S.Case No. 266 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
