This is the second attempt of the petitioner to obtain bail in connection with N.D.P.S. Case No. 50 of 2020 arising out of Kudra P.S. Case No. 368 of 2020 dated 14.12.2020 registered for the offences under Section 8(C)/20(b)(ii)/27(A) of the N.D.P.S. Act and Section 25(a-b)a/26/35 of the Arms Act. The petitioner is in custody since 15.12.2020. He has no criminal antecedent.

Earlier his prayer for bail was rejected after considering the gravity of the offences alleged. A report has been received from the learned trial court. It appears that in this case, the prosecution evidence has already been closed and the case was fixed at the stage of Section 313 Cr.P.C. on 27.04.2023.

No.50530 of 2022(4) dt.03-05-2023 2/2 In the aforesaid view of the matter, considering that the trial itself is going to be concluded very soon, this Court finds no reason to entertain this bail application. Let the learned trial court conclude the trial within a period of three months from the date of receipt/production of a copy of this order.

This application stands disposed of accordingly. In case, the trial is not concluded within the said period for no reason attributable to the petitioner, he may apply for bail in the learned court below itself which will be considered on its own merit.
