The petitioner apprehends his arrest in Complaint Case No. 2223(c) of 2012, registered for the offence punishable under Section 498A of the Indian Penal Code.

The complainant made allegation of demand of dowry and torture against the petitioner, the husband of the complainant.

Learned counsel for the petitioner submits that the marriage was solemnized in the year 2005 but the wife of the petitioner did not want to live in her matrimonial house. The petitioner thereafter filed matrimonial suit bearing No. 272 of 2011 on 18.11.2011. The complainant filed this complaint case after more than a year from the date of filing of the divorce case.

No.4171 of 2015 (2) dt.30-01-2015 2 / 2 Considering the facts aforesaid petitioner Vijayant Kumar Dubey @ Vigayant Dubey, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur (Ara) in connection with Complaint Case No. 2223(c) of 2012, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
