JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 326 and 307/34 of the Indian Penal Code.
The prosecution case is that the petitioner and other accused persons assaulted the father of the informant. It is specifically alleged that co-accused Bhushan Singh assaulted by sword causing injury on the right hand of the father of the informant as a result right hand of the father of the informant got chopped off. Father of the informant received altogether three injuries.
Considering the nature of injury caused, this Court is not inclined to grant anticipatory bail to the petitioner.
Patna High Court Cr.Misc. No.7341 of 2016 (2) dt.18-02-2016 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Barbigha P.S. Case No. 13 of 2016 pending in the court of learned ACJM-II, Sheikhpura. Accordingly, the application is disposed of.
