The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

Prosecution case, in short, is that the motorcycle of the informant, parked at the bathan of Bhrigun Yadav, was found missing.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.6.2019. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has come on his self confession. The petitioner had no knowledge that the motorcycle in question is stolen property. He has been made accused due to mistake of fact.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.
