The petitioner seeks regular bail in connection with Sitamarhi P.S. Case No. 144 of 2015 for the offences punishable under Section 302/34 of Indian Penal Code.

The allegation against the petitioner is regarding him stabbing the brother of the informant and upon being apprehended by the police, one big knife with blood spot, two mobiles and one live cartridge were recovered.

The learned counsel for the petitioner submits that the name of the petitioner has been dragged in the present case upon confessional statement of other co-accused person. It is stated that the petitioner is innocent and is languishing in custody since 19.3.2015. The learned counsel for the petitioner has further

No.31069 of 2018 (2) dt.23-05-2018 2/2 submitted that most of the accused persons have already been granted bail and, in fact, one accused person, similarly situated, has been granted bail by this Court vide order dated 24.7.2015 passed in Cr. Misc. No. 26385 of 2015, Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J. Ist, Sitamarhi in connection with S.T. No. 272 of 2015 arising out of Sitamarhi P.S. Case No. 144 of 2015.

It is further directed that the petitioner shall present on each and every date fixed before the court concerned and in case of his failure on two consecutive occasions, the present privilege of bail shall stand cancelled automatically. (Mohit Kumar Shah, J) BTiwary/- U T
