JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

As per the prosecution case, petitioner and other accused persons committed murder of informant's son-in-law to grab his property.

Learned counsel for the petitioner submits that there is no eye witness of the occurrence and petitioner has falsely been implicated in this case on the basis of suspicion. No substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Petitioner has claimed clean antecedent and he is in custody since 15.1.2021. Investigation is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

Patna High Court CR. MISC. No.59956 of 2021(2) dt.10-02-2022 2/2 petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XIII, Gaya in Atari Police Station Case No. 37 of 2019.
