The petitioner being the mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Sections 498A, 326 and 304B/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after four months of the marriage by causing burn injury for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that the accusation is omnibus and general. There is no eye witness to the occurrence and the thrust of accusation is

Patna High Court Cr.Misc. No.7528 of 2016 (6) dt.23-05-2016 2/2 against the husband of the victim, who, as per learned counsel for the petitioner, is in custody.

It is submitted by learned counsels for the informant and the State after going through the case dairy that the witnesses have suggested this fact that the petitioner was a party of causing burn injury to the victim.

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner in connection with Valmikinagar P.S. Case No. 70 of 2015 pending in the court of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
