2. The present petition has been preferred for the following relief/s:
(i) for issuance of an appropriate writ in the nature of CERTIORARI for quashing the order dated 28.09.2016 passed by the Respondent no.4 in L.A. Case No.110/201112,whereby and where under he has been pleased to withhold the payment of 20% of the compensation amount to the petitioner
Patna High Court CWJC No.1381 of 2017(4) dt.17-11-2025 2/3 against acquisition of his land of Khata No.353, Plot No.4559 on the basis of objection filed by the Respondent no.5;
(ii) for issuance of an appropriate writ in the nature of MANDAMUS, commanding and directing the Respondent Authorities for payment of withhold amount of compensation to the petitioner on the ground that if he was a valid title holder for payment of 80% compensation amount only because a title suit has been filed by the Respondent no.5,which is pending before the court for consideration when the title of petitioner's father was already declared by the court of competent jurisdiction in Title Suit No.236/9 of 1934/36;
(iii) for issuance of any other writ /writs, order/ orders, direction /directions for which the writ petitioner wold be found entitled under the facts and circumstances of the case.
3. Learned State Counsel submits that Title Suit No.
Patna High Court CWJC No.1381 of 2017(4) dt.17-11-2025 3/3 39 of 2013 which is pending before an appropriate Court.
4. This Court finds in the submission of the learned State counsel. However, since there is no appearance, the writ petition is dismissed for non-prosecution.
