JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-07-2019 The petitioner apprehends his arrest in connection with Bettiah Town P.S.Case No. 74 of 2018 registered under Sections 379, 414 and 511 of the Indian Penal Code.

Allegation against the petitioner is that informant after having his motorcycle parked near P.N.B. A.T.M., went inside the Shoe Shop then he saw that two persons were trying to break open the lock of his motorcycle and upon this when informant rushed towards his motorcycle, both of them started fleeing away, however, upon chase, one of them was apprehended, who disclosed his name as Samir Akhtar and upon enquiry, name of this petitioner has been disclosed by the apprehended accused. Mr. Umesh Chandra Verma, learned counsel for the petitioner, submits that petitioner has got no criminal antecedent

Patna High Court CR. MISC. No. 46555 of 2019(2) dt.26-07-2019 2/2 and his name has surfaced on the basis of statement of arrested co-accused. Learned counsel further submits that motorcycle was not stolen and only allegation that the petitioner allegedly along with other co-accused was trying to open the lock of the motorcycle.

After having heard learned counsel for the parties and taking into consideration the fact that petitioner has got no criminal antecedent and his name has surfaced on the basis of statement of co-accused as such I am inclined to grant anticipatory bail to the petitioner. Let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, West Champaran at Bettiah in connection with Bettiah Town P.S.Case No. 74 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
