JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 16-05-2016 Keeping in mind that the erstwhile employee was maintaining two families and he even had offspring from both wives, the Bihar State Power (Holding) Company Limited has rightly directed the two rival claimants for getting an appropriate declaration from a civil court of competent jurisdiction so that they can settle the post retiral dues of the erstwhile employee in accordance with the declaration of the civil court. Communication in this regard has already been made not only to the petitioners but even to the
Patna High Court CWJC No.5256 of 2016 dt.16-05-2016 Intervenors who have approached the Court in I.A. No. 3852 of 2016. In view of the above and also keeping in mind that certain legal battle have already been fought for maintenance earlier, this Court will not pass any order for settlement of retiral dues or claims at this juncture.
This writ application stands disposed of with the observation aforesaid.
