2. This application for anticipatory bail arises out of Bhagwan Bazar P.S. Case No. 350 of 2026, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. The prosecution case, in brief, is that while the informant was on patrolling duty, he saw two persons coming on two motorcycles, when they were directed to stop, both of them managed to flee away taking advantage of the darkness leaving behind their motorcycles and altogether 157.5 liters of foreign liquor was recovered jointly from both the motorcycles.

4. Learned counsel for the petitioner has submitted, referring to paragraph 10 of the application, that the

Patna High Court CR. MISC. No.48928 of 2026(2) dt.22-07-2026 2/3 motorcycles, from which the alleged recoveries have been made, does not belong to the petitioner. It has further been submitted that the procedure prescribed under Section 105 BNSS has not been followed with. It has further been submitted that the local inimical persons have named the petitioner to be the one of the persons who fled away from the place of occurrence. It has lastly been submitted that the petitioner has been made accused in altogether four cases of similar nature, but he is on bail in those cases.

5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioner.

6. Heard the parties and perused the record.

7. Considering the facts and circumstances, let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Exclusive Special Court, Excise Act-I, Saran at Chapra, in connection with Bhagwan Bazar P.S. Case No. 350 of 2026, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.
