JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-02-2015 Heard the learned counsel for the petitioners and the learned counsel for the State.

The petitioners apprehend their arrest in Fulwaria P.S. Case No. 100 of 2014 registered for the offence punishable under Sections 448, 341, 323, 324, 307, 352/34 of the Indian Penal Code. It is submitted that there is a case and counter case between both the parties for the same occurrence. The wife of the petitioner no.2 has lodged Fulwaria P.S. Case No.99/2014 against the informant. Both the parties have sustained injuries. The injuries sustained are reported to be simple in nature. Considering the facts and circumstances of the case, let the petitioners above-named be released on bail in the event of arrest or surrender within a period of four weeks on furnishing

Patna High Court Cr.Misc. No.4243 of 2015 (2) dt.02-02-2015 2/2 bail bonds of Rs.10,000/-eacg with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in Fulwaria P.S. Case No.100/2014 subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure and the other following conditions :

One of the bailors will be the close relative of the petitioners.

2.

The petitioners will not indulge in similar or in any other offence.

3.

The petitioners will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
