JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-04-2021 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State through virtual court proceeding.
Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in connection with Begusarai Mufassil P.S. Case No.293 of 2020 registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.
Patna High Court CR. MISC. No.6021 of 2021(2) dt.15-04-2021 2/3 The prosecution case in short is that son of the informant has been killed by the petitioner and co-accused persons due to dispute over money transaction and his dead body was thrown in the river.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case and has not committed any offence as alleged in the FIR. Petitioner has been made accused in this case only on the basis of suspicion as there is no eye-witness to the occurrence. It is submitted that on the confessional statement of the co-accused Mangal Singh, some material has been recovered from the possession of Mangal Singh but nothing has been recovered from the possession of this petitioner. The said Raj Kumar Singh @ Mangal Singh and one Pujeri Saw @Pujeri Sah have already been granted bail vide orders passed in Cr. Misc. No.34882/2020 dated 05.04.2021 and Cr. Misc. No.34955/2020 dated 04.01.2021 respectively. The petitioner has no criminal antecedent and has been languishing in custody since 13.06.2020.
Learned APP for the State and learned counsel for the informant have opposed the prayer for bail.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail
Patna High Court CR. MISC. No.6021 of 2021(2) dt.15-04-2021 3/3 bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Mufassil P.S. Case No.293 of 2020.
