2. Petitioner seeks regular bail in connection with Kachhawan P. S. Case No. 162 of 2023 in a case registered for the offences punishable under Sections 341, 323, 448, 302, 504/34 of the Indian Penal Code.
3. As per the prosecution case, on the alleged date and time of occurrence, all the F.I.R. named accused persons including this petitioner started abusing informant and when informant opposed, all the accused persons thrashed the father of informant. It is further alleged that co-accused Prabhu Pandey assaulted the father of informant with lathi and this petitioner slapped him on the nose and face. Co-accused Vicky Pandey hit the father of informant on chest due to which he fell down and
Patna High Court CR. MISC. No.56973 of 2024(3) dt.18-10-2024 2/2 died during the course of treatment.
4. Learned counsel for the petitioner submits that specific accusation of assaulting the father of informant is against co-accused Prabhu Pandey and Vicky Pandey. Petitioner is only alleged to have assaulted the deceased with fist and slaps on his face. Petitioner is a lady and she is in custody since 26.04.2024.
5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner is named in the F.I.R. with specific accusation that she assaulted the deceased and post-mortem report goes to show that deceased sustained multiple ante-mortem injuries.
6. Considering the nature of accusation and postmortem report, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Navya/- U T
