Petitioner is languishing in judicial custody since 31.01.2018 in connection with Wazirganj P.S. Case No. 565 of 2017 for offences punishable under Sections 363, 366-A, 34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that his daughter Riya Kumari, aged 13 years, went for tuition but did not return. On search, he was informed that 11 persons, named in the First Information Report, had taken his daughter away. When he went to get information from the house of the petitioner and two others, they abused and turned him away. It has been submitted by the learned counsel for the petitioner that he is innocent and just because he is the father of

He submits that the victim girl also in her statement under Section 164 Cr.P.C. has not named the petitioner and charge-sheet has already been submitted. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-1st, Gaya, in connection with Wazirganj P.S. Case No. 565 of 2017.
