The petitioner apprehends his arrest in Bakhri P.S. Case No. 354 of 2014, registered for the offences punishable under Section 7 of the Essential Commodities Act. According to the prosecution case two trucks bearing Registration Nos.

WB23A/8755 and WB23B/1955 were intercepted and from there 327 and 319 packets of rice were recovered. Vikash Singh, the proprietor of truck and Angad Singh and Krishna Singh drivers of both the truck were apprehended.

Learned counsel for the petitioner submits that the petitioner is father of Vikash Singh. The petitioner is an old man and he is under treatment. His son Vikash Singh was engaged in

Patna High Court Cr.Misc. No.5489 of 2015 (2) dt.10-02-2015 his business. The rice has not come under Control Act. All the three persons apprehended on the spot have already been enlarged on bail.

Considering the facts that the petitioner is father of Vikash Singh who was apprehended on the spot along with two truck from which 327 and 319 packets of rice were recovered, he, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Begusarai in connection with Bakhri P.S. Case No. 354 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
