Patna High Court CR. MISC. No.59858 of 2021(2) dt.13-07-2022 2/3 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Purshottampur P.S. Case No. 15 of 2021 registered for offence punishable under sections 147, 148, 341, 342, 353, 354 (B), 307, 379, 188, 504 and 506 of the Indian Penal Code. As per allegation, when the process of selection of Anganbari Sevika was going on, the petitioners along with other accused persons created hindrance in the selection process and they outraged the modesty of the informant. The allegation against the petitioner Mahtab Alam is that he snatched golden chain from the neck of the informant. The accused persons made captive the selection team.
The learned counsel for the petitioners has submitted that the entire allegation is false. The petitioners are the persons of clean antecedents. The real fact is that the selected candidate Arbun Nesha had secured less marks than one candidate, namely, Sabbu Khatoon, whose total marks was 67.67%, whereas the marks obtained by the selected candidate Arbun Nesha was 64.83%. The petitioners were protesting, as the Selection Committee was not transparent in the selection of the candidate.

No.59858 of 2021(2) dt.13-07-2022 3/3 Considering the above-mentioned facts and circumstances as well as the clean antecedents of the petitioners, let them, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Purshottampur P.S. Case No. 15 of 2021, subject to condition as laid down under section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
