JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2016 Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 341, 323, 307, 354, 379, 504, 506/ 34 of the Indian Penal Code. The prosecution case is that the petitioner and other accused persons entered into the house of the informant, assaulted her after dragging her from the house. It is specifically alleged against the petitioner that she pulled the informant down on the ground by catching hold her hair and took out golden ear-ring and gold chain from the body of the informant.
It is submitted by learned counsel for the petitioner that even assuming the accusation, no offence under Sections 307, 354 I.P.C is made out against the petitioner. There is counter version of the occurrence also. For the occurrence of 18.09.2015 at 12:00 P.M the F.I.R was registered

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of accusation, there being counter version of the occurrence and petitioner being lady, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Bihariganj P.S. Case No. 183 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
