The petitioner seeks regular bail in connection with Karaghar PS case no. 140 of 2017 instituted for the offences punishable under Sections 341, 323, 395, 365 of Indian Penal Code.

The allegation of the prosecution is that the accused persons had intercepted the tractor of the informant as well as one other tractor and after apprehending the drivers of the said tractors, the said accused persons had forcibly taken away the tractor of the informant.

The learned counsel for the petitioner submits that the petitioner is innocent, he is a non-FIR named accused person

Patna High Court Cr.Misc. No.28215 of 2018 (2) dt.09-05-2018 2/2 and his name transpired during the confessional statement made by the co-accused person Saroj Singh who has already been granted bail by this Court vide order dated 26.04.2018 passed in Cr.Misc. no. 18583 of 2018.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM, Rohtas at Sasaram in connection with Karaghar PS case no. 140 of 2017.
