JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Kako P.S. Case No. 152 of 2017, disclosing offences under Sections 468, 409 and 420/34 of IPC. Allegation as per F.I.R. is that during the period 20092010, the amount of Rs.3,53084/- has been disbursed to the different Panchayat Secretaries for carrying out in 12th Finance Commission Scheme, but no audit report has been submitted and so far as, this petitioner is concerned, it is said that Rs.7,06,883/- has been disbursed with the Panchayat Secretaries of his Panchayat and he has also not produced the audit report. Petitioner being Mukhiya has also been made accused in this case.
Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against him and

Having heard both sides, considering the aforesaid aspect of the matter that several other accused having similar allegation, have been granted privilege of anticipatory bail by different Co-ordinate Benches of this Court, vide order dated 11.01.2018 passed in Criminal Misc. No. 623 of 2018, vide order dated 19.02.2018 passed in Criminal Misc. No. 6705 of 2018 and vide order dated 12.12.2018 passed in Criminal Misc. No. 53475 of 2018, which are annexed as Annexure-3 series, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, 1st Class, Jehanabad, in connection with Kako P.S. Case No. 152 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
