The petitioners apprehend their arrest in Baniyapur P.S. Case No. 220/2014 registered under Sections 304(B)/201/34 of the Indian Penal Code.

Birendra Thakur, the father of the deceased, made allegation that his daughter was done away with by the accused persons.

Learned counsel for the petitioners submits that the petitioners are uncle and aunt of the husband of the deceased. They are separate in mess and they have no manner of concern with the family affairs of Satish Rai, the husband of the deceased. On perusal of the records, it appears that the informant himself stated that Satish Rai (husband of the deceased),

Patna High Court Cr.Misc. No.4914 of 2015 (2) dt.04-02-2015 2/2 and Parmila Devi (wife of Murari Rai) conspired with other accused persons in commission of crime. There is no allegation of demand of torture against the petitioners.

Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran at Chapra in Baniyapur P.S. Case No. 220/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
