JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory arises out of RPF Post / Purnea Case No. 1(6)15, disclosing offences under Sections 3(a) and 4 of Railway Property (Unlawful Possession) Act. From the First Information Report, it appears that the Railway Protection Force in course of raids conducted on 02.06.2015 recovered 15 bags of maize from the house of co-accused Ravindra Sah and 25 bags of maize from the house of Tarun Vardhan.

It appears that the name of the petitioner surfaced in confessional statement made before the members of Railway Protection Force by Dipak Kumar and Krishna Kumar Sah whose names are taken by Ravindra Sah and Tarun Vardhan in course of investigation.

against the present petitioner. The petitioner has no criminal antecedents as stated in paragraph 3 of the application. In view of the submissions as above, this application is allowed. Let the petitioner above-named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Katihar in connection with RPF Post / Purnea Case No. 1(6)15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
