There is a delay of six days in filing the objection as per Rules-17 and 18 of Patna High Court Rules, Chapter XI. Counsel for the caveator-objector placed reliance on Order dated 28.08.2009 passed in Testamentary Suit No. 01 of 2009 of this High Court. The Counsel for the applicant has no objection, if this case is converted into Testamentary Suit.

Let the case be converted into Testamentary Suit and the objection filed herein will be treated as W.S. to the Suit. Near relative nos. 1, 2 and 5 will be Defendants to the Suit. Parties are directed to file proposed issues, list of witnesses along with their examination-in-chief on affidavit and original documents within four weeks.
