JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 366A/34 of the Indian Penal Code. Allegation against the petitioners is that they have abducted daughter of informant.
It is submitted on behalf of the petitioners that they have got no criminal antecedent. As per F.I.R., the victim is said to have eloped with Md. Anwar. Petitioners are not named in the F.I.R. From perusal of Annexure-4 it is evident that the said victim girl has married Md. Anwar. The said girl has already been recovered. The other co-accused has been granted bail vide Cr. Misc. no. 19580 of 2015.
On behalf of the State, it is submitted that petitioners are not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of
