JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-08-2019 Mr. Ansul, learned counsel for the petitioner, submitted that misuse of privilege of bail is not because of any fault on the part of the petitioner, but due to compelling and unavoidable reason as the petitioner is unable to sort out the differences with his wife. He contended that matrimonial discord and incompatibility are such that the parties are not willing to live together and under such circumstance, even though the petitioner has not given consent to take his wife to the matrimonial home, the provisional bail was granted by the court below recording his consent to take his wife to the matrimonial home.
