05-02-2015.

Heard Mr. Raghav Prasad, learned counsel appearing on behalf of the petitioner and A.P.P. for the State. Petitioner apprehends his arrest in Mahila P.S.Case No.116 of 2014 under sections 376, 493 and 506 of the Indian Penal Code.

Afsana Khatoon, the informant, made an allegation that the petitioner, on the pretext of marrying her, established physical relation and she became pregnant but she was aborted and later, the petitioner refused to marry with her.

It appears that the petitioner established physical relation with the informant on the pretext of marrying with her and she was also aborted, I am not inclined to enlarge the petitioner on anticipatory bail and accordingly, the same is rejected. The petitioner may surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order and the court below shall consider the prayer of the petitioner without being prejudice by the order of this court

Patna High Court Cr.Misc. No.5068 of 2015 (2) dt.05-02-2015 and taking into consideration that the petitioner happens to be cosharer of the informant. (Prabhat Kumar Jha, J).
