====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 19-08-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Anandpur P.S. Case No. 37 of 2025 dated 08.05.2025 registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109(1), 303(2) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the informant was going to participate in the marriage ceremony of his nephew, in the meantime, the petitioner and the co-accused persons surrounded the informant and the co-accused Milu Yadav assaulted the informant with khanti on the head of the informant

Patna High Court CR. MISC. No.49607 of 2025(2) dt.19-08-2025 2/3 due to which he sustained injury when the informant's family members came to rescue him, all the accused persons assaulted them and snatched the chain of Babita Devi.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. There is no specific allegation against the petitioner rather the specific allegation of assaulting the informant with khanti is against the co-accused, Milu Yadav. The injuries sustained by the injured are simple in nature as stated in para-9 of the bail petition. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody in this case since 09.05.2025.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
